TheStreet went one-on-one with Makan Delrahim, Assistant Attorney General for the Antitrust Division of the U.S. Department of Justice, at The Deal's Corporate Governance Conference in New York on Thursday.
On June 12, Judge Richard Leon is set to rule on AT&T's (T) proposed acquisition of Time Warner (TWX) , which the Department of Justice has sued to block.
"Like everybody else, we're waiting to see what the judge is going to rule," Delrahim told TheStreet. "We feel good about the case we put on and [are] as confident about it today as we were in November when we brought the case."
Delrahim said he has no concerns with "most" vertical mergers.
"Vertical mergers can have foreclosure effects or raising a rival's costs," he said. "There's no policy against vertical mergers perse, but by the same token, there isn't a free pass for vertical mergers."
